The legal test is whether the failure to treat is evidence of deliberate indifference that the prisoners will experience pain. If so, the refusal to give proper treatment becomes a part of the punishment regime. Researchers should explore how often doctors in the free world are indifferent to their patients' needs. Many doctors seem disinterested, not to say uninterested, in what we say about our symptoms including the level of pain. This is unacceptable. If prison doctors and their employers are held accountable for failing to give effective treatment as needed, the same standard should be taken for law-abiding citizens. The constitution should not favor prisoners over the rest of the world. Everyone in pain should always be given effective treatment. Ambien and coffee may have to work together

Even before the recession hit, people were being asked to work longer to help keep costs under control. When the economy decided to collapse, those who still had jobs were expected to pick up the slack generated by those unlucky enough to be terminated. This month sees the publication of another Cochrane meta-analysis. This time, it's re-evaluating thirteen studies looking at the behavior of younger people in simulated conditions. Different groups are then allowed to take a nap, asked to work with different types of lighting in operation, or given a placebo, coffee or other drinks and substances suggested as effective boosts to performance. Overall, coffee has emerged as the most positive "intervention". Except there are problems in drawing any firm real-world conclusions. How young people may react is not necessarily any guide to the way older workers might react when going through shift or other changes to sleeping times. More importantly, the methods used mainly tested mental alertness, i.e. how well participants could memorise, calculate and concentrate on different tasks. This is no guide as to what might happen to accident rates if the majority of workers operating machinery suddenly began to drink large amounts of coffee while on the job.

There's no doubt that feeling sleepy and tired on the job reduces concentration, demotivates and leads to more mistakes being made. Given coffee's power to boost alertness, this should be a benefit to the workplace. Except there's ample research evidence of increasingly poor performance among young doctors who are forced to be on call for long periods of time. They do not find drinking coffee reduces their capacity for error. If you order ambien or an equivalent sleeping pill, it won't be the answer. If people are not getting enough sleep or their natural sleep patterns are being disrupted, taking a sleeping pill may actually make the problem worse. For example, a person who takes either the conventional tablet or ambien should be prepared to spend at least eight hours asleep. The first has been a general toning down of the rhetoric in favor of scientific debate. When marijuana was first criminalized back in the 1930s, the medical profession stood together and denounced the drug as a tool of the Devil, tempting people into sin and depravity. Today sees a significant number of doctors singing a different tune. First, a gesture to the traditional group: there is no doubt that smoking marijuana can and does cause lung cancer and, over time, there is evidence suggesting loss of memory and some brain damage. But there is also an impressive body of international evidence proving marijuana highly effective in giving pain relief. The use has to build up over at least six months. Once a stable concentration is achieved in the blood stream, it relieves chronic pain from arthritis, fibromyalgia, multiple sclerosis and cancers.

The second justification is fiscal. The sale of medical marijuana already makes a significant contribution to state funds through the tax system. In a recession, all contributions are gratefully received. If the outright legalization goes through in California, it is estimated the annual tax take will rise from about $200 million to $1.5 billion. It will also lead to a better system of regulation so that, like alcohol, its distribution can be controlled. None of this changes the need for "conventional" drugs to relieve pain. Tramadol in its different forms will remain the first response to moderate to severe pain. But in chronic cases, the continuing use of any drug can lead to dependence and the debate shifts. Which of the drugs is better when use may be indicated for years?
